VA Claim Denied? Understand Your Review Options
A denial is not always the end of a VA claim. The decision letter should explain what VA accepted, what it found missing, and which review options are available.
A VA denial is not final. Under the Appeals Modernization Act, veterans can file a Supplemental Claim with new evidence, request a Higher-Level Review, or appeal to the Board of Veterans' Appeals. The right pathway depends on the case facts, timeline, and reason for denial.
Why VA claims are denied
- Insufficient medical nexus between condition and service
- Lack of an in-service event, injury, or exposure documentation
- C&P examination findings that don't support the claim
- Rating below the threshold for compensation
- Procedural or evidence-development gaps
Your three appeal lanes
1. Supplemental Claim
File new and relevant evidence the VA has not previously considered. VA helps develop the evidence further. Best when you have additional medical records, IMOs, or buddy statements.
2. Higher-Level Review (HLR)
A senior VA reviewer takes a fresh look at the existing record. No new evidence is permitted. Best when the denial appears to involve a clear error in interpretation of the existing file.
3. Board of Veterans' Appeals (BVA)
Appeal to a Veterans Law Judge. Three docket options: direct review, evidence submission, and hearing. Longest path but the most comprehensive review.
PACT Act Supplemental Claims for old denials
If your previous denial was for a condition now presumptive under the PACT Act, a Supplemental Claim may allow that claim to be reconsidered based on the change in law.

Can the PACT Act reopen a previously denied claim?
A veteran may be able to file a Supplemental Claim when a condition or location is now covered or when new and relevant evidence is available.
